Terms of Service

1. Agreement to Terms

By accessing or using the mobile games, the website at sequel.games, or any related services (collectively, the "Service") provided by Sequel Games Inc. and its subsidiary Sequel Games AB (collectively, "Sequel Games," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old (or the higher minimum age required by your country's local law) to use the Service. If you are under the age of legal majority in your jurisdiction, you represent that you have your parent's or legal guardian's permission to use the Service. The Service is directed at adults and is not designed for young children.

3. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after such changes have been made constitutes your acceptance of the new Terms.

5. Creating an Account

To use certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and keep your account information up-to-date. You are responsible for safeguarding your account and for any activity that occurs under it.

6. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial purposes.

7. User Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any laws.
  • Accessing or tampering with the Service's server systems or networks.
  • Interfering with the enjoyment of the Service by others.
  • Cheating, exploiting bugs, or using bots, automation, or modified clients to gain an unfair advantage.
  • Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service.

8. Purchases and Payments

If you choose to make a purchase within the Service, you agree to pay all fees or charges associated with the purchase. Purchases are processed by Apple's App Store or the Google Play Store and are subject to those platforms' terms and refund policies. All transactions are otherwise final and non-refundable, except as required by law.

9. Virtual Goods and Currencies

The Service may include virtual goods and currencies. These virtual items have no real-world value, are licensed (not sold) to you for use within the Service, and may not be exchanged for real money or monetary value outside the Service.

10. Intellectual Property

All rights, title, and interest in and to the Service (excluding user-generated content) are and will remain the exclusive property of Sequel Games and its licensors. Nothing in these Terms grants you any right to use Sequel Games' trademarks, logos, or other brand features without our prior written permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SEQUEL GAMES DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEQUEL GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR GOODS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total aggregate liability to you for any claims arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the six months preceding the claim, or (b) USD $100. Nothing in these Terms limits liability that cannot be limited by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sequel Games and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Termination

We may terminate or suspend your access to the Service at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You may stop using the Service at any time.

15. Governing Law

If you reside in the European Economic Area, the United Kingdom, or Switzerland, these Terms are governed by the laws of Sweden, without regard to its conflict of law principles. For all other users, these Terms are governed by the laws of the United States, without regard to its conflict of law principles. Nothing in this section deprives you of any mandatory consumer protection rights you have under the law of your country of residence.

16. Dispute Resolution

You agree that any disputes between you and Sequel Games will be resolved by binding, individual arbitration and you waive your right to participate in a class action lawsuit or class-wide arbitration. This clause does not apply where prohibited by applicable law (including for many EEA consumers).

17. Apple App Store Additional Terms

If you access the Service through Apple's App Store, the following additional terms apply:

  • Acknowledgment. These Terms are an agreement solely between you and Sequel Games, not with Apple. Apple is not responsible for the Service or its content.
  • Scope of License. Your license to use the Service is limited to use on Apple-branded devices that you own or control, and as permitted by the Usage Rules in the Apple App Store Terms of Service.
  • Maintenance and Support. Sequel Games is solely responsible for providing any maintenance and support for the Service. Apple has no obligation to provide maintenance or support.
  • Warranty. Sequel Games is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Service.
  • Product Claims. Sequel Games, not Apple, is responsible for addressing any claims by you or any third party relating to the Service, including product liability, legal or regulatory non-compliance, and consumer protection claims.
  • Intellectual Property. In the event of any third-party claim that the Service or your use of it infringes that party's intellectual property rights, Sequel Games, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer Contact. For questions, complaints, or claims regarding the Service, contact Sequel Games at support@sequel.games .
  • Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

20. Miscellaneous

These Terms constitute the entire agreement between you and Sequel Games regarding the use of the Service, superseding any prior agreements between you and Sequel Games relating to your use of the Service.
